• Interfere with or disrupt the integrity or performance of the Services
• Use the Services to transmit any malicious code, spam, or harmful content
• Reproduce, distribute, or create derivative works from the Services without our written consent
• Use automated means (bots, scrapers, etc.) to access the Services without our permission

5. SMS/Text Messaging Terms

By providing your phone number and opting in to receive SMS or text messages from Homiere, you expressly consent to receive recurring automated text messages related to our Services, including but not limited to property listing alerts and account notifications. Your consent to receive SMS messages is not a condition of purchasing any goods or services from Homiere.

Message Frequency

You may receive up to 1 message per day, depending on your account settings and property alert configurations. Message frequency may vary based on market activity and your notification preferences.

Message and Data Rates

Message and data rates may apply. Please contact your wireless carrier for details about your text messaging plan and any charges that may apply.

Opt-Out

You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message, and no further messages will be sent unless you re-subscribe. You may also opt out by contacting us at hello@homiere.com.

Carrier Liability

Carriers (e.g., T-Mobile, AT&T, Verizon, etc.) are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless carrier and network availability. Homiere is not responsible for messages that are not delivered due to carrier issues, device incompatibility, or other factors outside our control.

Mobile Opt-In Data

We do not share, sell, or distribute your mobile opt-in data or consent information with any third parties for their own marketing purposes. Mobile opt-in data collected through our SMS program will only be used to send you the messages you have consented to receive and to administer our messaging program.

6. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, data, software, AI-generated insights, and analyses, are owned by or licensed to Homiere and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content from our Services without our express written permission.

The property data, analytics, and AI-generated insights provided through our Services are for informational purposes only and do not constitute professional real estate, financial, legal, or investment advice. While we strive for accuracy, we make no guarantees regarding the completeness, reliability, or timeliness of any information provided through the Services. You should independently verify all information before making any real estate or investment decisions.

8. Third-Party Services

Our Services may contain links to or integrate with third-party websites, services, or content that are not owned or controlled by Homiere. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. Your use of third-party services is at your own risk and subject to the terms and conditions of those third parties.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Homiere and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Services.

In no event shall our total liability to you exceed the amount you have paid us, if any, in the twelve (12) months preceding the event giving rise to the liability.

10. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free from harmful components.
